Best Use Alternatives & Options

Purpose: identify acceptable alternative uses for the property(ies) and plan course of action to identify possible prospective purchasers of parcels if Repking decides to sell or back out of closing. Create list of suggested alternative sites for Diamante pre-school.

Legal Representation

The group of neighbors closest to 625 Hillside and the other 2 parcels belonging to the church have signed a retainer agreement with a lawyer. In the next few days a letter will go out to the other parties presenting our concerns and our plans to aggressive protect our rights.

We have done this in order to protect our rights in this process and to represent us if this issue progresses and we need to present all of our concerns about traffic, safety, reduced property values, loss of trees and open space and the nuisance issues to the Planning Board and/or Board of Trustees. We felt it a necessary step given the speed with which this issue has moved thus far and the manner in which communication has been managed.

Impact on Property Values

Purpose: contact realtors to render written opinion on negative impact on property values; research the School's requirement to obtain a "Land Use" opinion

Policy & Regulations

Purpose: identify applicable zoning & Special Use regulations and prioritize issues; correspond with group leader to gauge strengths & weaknesses on issues; educate spokesperson(s) for the group on the facts and status of other groups' activities via the leaders.

Fully explore and document the Planning Board and Village Board processes. Keep in contact with Village to monitor progress of Repking’s Proposal

Citizen Advocacy Center

Preservation of Church, Green Space, Trees & Nuisance Issues

Purpose: Explore issues around the destruction of trees and open space, preservation of church

Investigate negative effects of noise, pollution and possibly lights as well

I know the church was given some architectural award when it was first built. Carl Cepuran said he had the history and I'll try to get that posted. I know there is considerable work to be done to make it suitable for a school; there are asbestos tiles in the basement, electrical needs to be updated, there is only 1 bathroom and the max capacity is 120.

Questions:
Does it qualify for any sort of protected status?
Even if it's a long shot would starting the process for review protect it in any way?
And what about the land that was sold to the church for $1? Were there any conditions on this that would complicate selling of the land in order to subdivide for 2 single family homes?

What does the Village Zoning Code say?

This is available on the village website but I was unable to find it. I am copying verbatim.

CHAPTER 10 - Administration and Enforcement

(E) The Plan Commission shall not recommend that a Special Use be granted nor shall the Village Board grant a Special Use, unless it shall find, based upon the evidence prsented to the Plan Commission in each specific case, that the Special Use:

  1. Will be harmonious with and in accordance with the general objectives, or within specific objective of the Comprehensive Plan and/or this Zoning Code;
  2. Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area;
